Our Commitment

Hinton Hygiene — Hazardous & Offensive Waste Management Compliance

At Hinton Hygiene, we take our environmental and legal responsibilities seriously. We are committed to managing hazardous and offensive waste in full compliance with UK law, ensuring the safety of our staff, clients, and the environment. This page outlines how we comply — and what it means for you.

Regulatory Framework & Key Legislation
We follow all relevant UK legislation and official guidance, including:
Hazardous Waste (England and Wales) Regulations 2005. This sets out the requirements for classification, storage, movement, and disposal of hazardous waste. Legislation.gov.uk+1
Environmental Protection Act 1990 — specifically the “duty of care” under Section 34. GOV.UK+1
Waste Duty of Care Code of Practice — provides practical guidance on how to meet duty-of-care obligations. GOV.UK
Technical Guidance WM2: Hazardous Waste — helps correctly classify and code wastes for compliance. Wikipedia+1
We also follow official guidance from the Environment Agency (EA) and the Health and Safety Executive (HSE) regarding hazardous and hygiene/offensive waste management. HSE+2HSE+2

What Qualifies as Hazardous or Offensive Waste
Hazardous Waste

Waste is considered hazardous if it — or the material or substances it contains — may cause harm to people or the environment. Examples include, but are not limited to: chemicals (e.g., solvents, print toner), oils (excluding edible oils), batteries, asbestos-containing material, equipment containing ozone-depleting substances (e.g., old fridges), contaminated containers, etc. GOV.UK+1
Offensive / Hygiene Waste
Offensive, from non-clinical settings. HSE+1
Although offensive waste is generally non-hazardous (unless it is classified as hazardous). HSE+1

Our Compliance Process

1. Classification & Assessment
Every waste stream is assessed to determine whether it qualifies as hazardous, offensive/hygiene, or non-hazardous.
For hazardous waste, we apply the classification and coding rules set out by Technical Guidance WM2 — ensuring correct six-digit codes, waste descriptions, and hazard properties so downstream handlers know precisely what they are dealing with.

2. Authorized Carriers & Facilities Only
We only transfer waste to authorized, licensed, or permitted carriers, brokers, or disposal/recycling facilities under UK regulations. This prevents illegal or improper waste disposal. This is a core “duty of care” requirement under the Waste Duty of Care Code of Practice. GOV.UK+2UK Rules+2
We verify — and keep records of — the carrier’s license/permit number and the destination facility’s authorisation before any waste leaves our site.

3. Documentation & Tracking
For all hazardous waste consignments leaving our premises, we complete a legally required Hazardous Waste Consignment Note, providing full details (producer, description, hazard classification, quantity, carrier, destination, date, signatures, etc.). We retain a copy, and the carrier receives the required copies. HSE+2UK Rules+2
For offensive or non-hazardous waste transfers, we issue a Waste Transfer Note or equivalent documentation, as required.
We maintain secure and accurate records of all waste consignments — including consignment notes, transfer receipts, carrier and facility details, and any refusals/rejections — in accordance with the legislation. For hazardous waste, records are retained for at least 3 years. GOV.UK+2Legislation.gov.uk+2

4. Secure Storage & Handling On-Site
Waste is stored securely and appropriately (labelled containers, secure storage areas, leak-proof containers, no unauthorized mixing of hazardous with non-hazardous or offensive waste unless permitted).
No waste is deposited, treated, or disposed of unless done via a licensed or permitted facility — unauthorized disposal is strictly prohibited. GOV.UK+2Legislation.gov.uk+2

5. Periodic Review & Audit
We conduct regular internal audits of our waste generation, classification, storage, and disposal processes to ensure ongoing compliance.
We ensure our staff are trained in waste handling, classification, and documentation.

Why Compliance Matters
Legal Risk: Failure to comply with “duty of care”, mis-describing hazardous waste, or using unlicensed carriers/facilities is a criminal offence under the Environmental Protection Act and the Hazardous Waste Regulations. Penalties may include unlimited fines or fixed-penalty notices. GOV.UK+1

Health & Safety: Incorrect handling of hazardous or offensive waste can pose serious risks, including chemical exposure, contamination, infection, and environmental damage. Proper classification, storage, transport, and disposal reduce those risks. HSE+2GOV.UK+2

Environmental Protection: Proper disposal prevents harmful substances from polluting soil, water, or air.
